This is a COMBINATION of two interconnected units a 1BR in front (with the massive living room) and a 2BR in back opening up to the large deck area.

We are UNIQUELY suited to conventioneers and people who work while away because NOLA rentals have notoriously spotty WiFi. We have the fastest service available and extenders so you can watch full screen HD from the backyard. We are suited to groups that like the proximity but want piece and quiet and an experience of living in a real neighborhood. It is an unusually quiet area for its proximity to the quarter. The other uniqueness is that historically this area was the "country" in the 1840s and so the lots, homes, and room sizes are twice the size of properties in the Marigny and the Quarter, just a block away.

SHORT-TERM RENTAL CONTRACT

This Short-Term Rental Contract (Contract) is made by and between XXXXXXX XXXXXXXXXX (Agent) and ________________________________ (Contracting Guest) as of the date last set forth on the signature page of this Contract. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

1. AGENT FOR OWNER: Agent is a Property Management Company which rents private homes, condominium units, cottages, cabins, and the like (The Property) for and on behalf of its owner. Neither the owner of The Property nor the Agent is responsible or liable for any loss to any Guest (including other guests, licensees and invitees) or personal property, including any accident, death, injury, or damage of any kind by any cause to any guest or occupant (including other guests, licensees and invitees), whether resulting from acts of God, Nature, recreational activities, or any other event.

The properties managed by Agent are privately owned, and, as such, reflect the needs and tastes of the owners. The conditions of The Property, as well as the furnishings and amenities, may vary as per the owner’s desires; Agent assures that all properties are well maintained. All efforts have been made to ensure that the descriptions of The Property are true and correct; however, Agent cannot be responsible for changes made by the owner as to the furnishings or equipment in The Property. Property listings and descriptions are updated regularly. There shall be no refunds due to minor discrepancies with the website or other online listings.

2. RESPONSIBLE PARTY & FALSIFIED RESERVATIONS: Contracting Guest is an adult and shall be an occupant of The Property during the entire reserved Term: Contracting Guest shall be the first occupant to enter The Property and the last one to leave. All other arrangements must be approved for, in writing, by Agent and may require a newly signed Contract. Contracting Guest assumes responsibility for all actions of all occupants at all times, including actions of other guests, licensees and invitees. No keys or entry code shall be issued to anyone who is not an adult. Any reservation obtained by Contracting Guest under false pretense shall result in forfeiture of all monies paid to date; any reservation obtained by Contracting Guest under false pretense shall only receive a return of Security/Damage Deposit if one is held by Agent, minus any fees, costs or penalties due to said false reservation. Any reservation obtained by Contracting Guest under false pretense shall result in the immediate eviction of all occupants from The Property; any occupant already in possession of The Property shall be considered an illegal occupant and reported immediately to local police authorities for removal. Any reservation obtained by Contracting Guest under false pretense shall be cause for Agent to prevent anyone from entering or taking possession of The Property.

3. LICENSE TO OCCUPY: It is expressly understood and agreed upon that this is a short-term vacation-rental Contract and is not a lease or other long-term residential tenancy agreement. This Contract is only for the licensed use of The Property for the stated term of the Contracting Guest’s reservation; it creates no property or guest rights for any guest and no right to renewal, nor for recurring usage. Contracting Guest acknowledges that he/she has another primary residence and that this is a transient occupancy of The Property.

4. TERM OF THE LICENSE: The LICENSE begins at 4pm on the “Check-in Date” and ends at 12pm (noon) on the “Check-out Date,” unless otherwise stated in Contracting Guest’s Booking Confirmation, to be delivered upon the signing of this contract.

NOTE: Electronic door passcodes shall only function during the Term of the License, the dates and times of which are stated in Contracting Guest’s Booking Confirmation. (Due to same-day check-ins, we cannot accommodate early arrival or luggage drop-offs, late departures, or late luggage pick-ups, unless pre-arranged, -signed, and -paid for with Agent.)

6. THE PREMISES: This is a privately-owned historic home and property. To preserve The Property, the Contracting Guest understands and agrees that all guests are required to: REMOVE THEIR SHOES while inside The Property, and to CARRY, rather than DRAG, ROLL, OR CLOMP any luggage, baggage or other heavy item across any floor, step or staircase, whether indoors or outdoors, up steps or down, at all times. Contracting Guest acknowledges that some members of his or her party may require assistance with heavy, over-sized luggage or baggage or other items, and Contracting Guest agrees to provide such assistance at all times to avoid damaging The Property’s flooring, steps, staircases, or any other aspect of The Property.

Due to the historic nature of this property, absolutely no high-heels are permitted on the hardwood or laminate floors, anywhere, at any time. Contracting Guest agrees that no shoes shall be worn on carpets. Contracting Guest further agrees that no bicycles or other heavy equipment (including construction, photographic, or sound equipment) of any kind will be kept inside The Property. Please see Parties, Events & Filming in House Rules below.

Note: Damage claims and repairs to historic flooring, steps, and staircases are costly, and while in use, are at risk of Contracting Guest. Floors, steps, and staircases are inspected by Management on a regular basis.

Animals are not permitted on the property at any time. Any ANIMAL, CREATURE, OR PET INTENDED TO BE BROUGHT ONTO THE PROPERTY FOR ANY REASON—AT ANY TIME—SHALL REQUIRE A PREVIOUSLY SIGNED ANIMAL CONSENT FORM—as well as any additional fees—received by Agent prior to the signing of this Contract. Furthermore, Contracting Guest agrees that ANY KNOWN OR UNKNOWN INTENTION OF ANY GUEST TO BRING AN ANIMAL, CREATURE, OR PET ONTO THE PROPERTY shall be declared to Agent prior to booking and shall be made known to Agent no later than the signing of this Contract. Contracting Guest agrees that any animal brought onto The Property at any time, by any guest, without previous consent of Agent, shall be cause for immediate eviction as well as for all additional charges or fees toward the remediation of The Property to the state prior to Contracting Guest’s and party’s arrival.

Due to the historic nature of The Property, at NO time may any decorations, adornments or other party favors be installed or placed on The Property that require nails, screws, thumbtacks, tape, glue, paint, wax, or any other means of attachment that may cause damage to any walls, ceilings, floors, moldings, trim, windows, doors, siding, fixtures, or to any other aspect of the interior or exterior of The Property. Please see Parties, Events & Filming in House Rules below.

Contracting Guest is responsible for reviewing—and at all times agrees to abide by—this Contract and the Rental/House Rules (hereby attached as Exhibit A) while in possession of The Property, and shall cause all members of the party (including other guests, licensees and invitees on The Property) to abide by this Contract and the Rental/House Rules at all times while in possession of The Property. Damage to The Property caused by the failure to adhere to the Rental/House Rules and this Contract shall result in deductions from the refundable security/damage deposit and/or billed directly to Contracting Guest and may be cause for immediate eviction.

7. RENTAL RATE, DEPOSIT AND FEES:
a. Refundable Security/Damage Deposit: Covers Agent against damage and/or loss.
Please refer to your Payment Invoice for Deposit amount. The Deposit is for Damage and/or Loss against deductions due to:
i. damage to The Property or its furnishings while in Contracting Guest’s possession and occupation;
ii. debris, garbage or other litter requiring excessive cleaning after departure. (A good rule of thumb is: If you bring it into the Unit, you must remove it when you depart.) Please refer to Rental/House Rules for trash disposal details at your reserved property;
iii. any other unanticipated costs incurred by owner or by Agent due to Contracting Guest’s stay.

8. MAXIMUM OCCUPANCY & RENTAL PARTY: The maximum number of guests is limited to ______________persons. For insurance purposes, the rental party MUST consist of Contracting Guest, and the following persons (FULL NAME and AGE of each guest) listed below. ALL CHANGES TO “COMPLETE GUEST LIST” MUST BE PUT FORWARD IN WRITING TO AGENT PRIOR TO ARRIVAL DATE, and may require a newly completed Contract. No showing up with different or “extra” guests; additional fees shall apply.

9. ASSIGNMENT AND SUBLETTING: The Contracting Guest and party shall not assign this Contract nor sublet any portion of The Property without prior written consent of Agent.

10. ACCESS: Contracting Guest shall allow Agent (and assigns) access to The Property for purposes of repair and inspection. Agent shall exercise this right of access in a reasonable manner.

11. INJURY, LOSS, ACCIDENTS: All guests assume and agree that Agent is not responsible for any accidents, injuries, illnesses, or thefts that may occur while in possession of The Property, the premises, or any of its facilities. The Agent is not responsible for the loss of personal belongings, valuables, or other material items of any guest, at any time, for any reason. By accepting this reservation, it is agreed that all guests are expressly assuming risk of any and all harm arising from their use of The Property, the premises, or its facilities, as well as for others whom they invite onto The Property. All guests agree to indemnify and hold harmless both Agent and property owner from all liability, loss, or damage arising from any nuisance or harm made or suffered while in possession of The Property, whether from carelessness, neglect, improper conduct, or any other violation of this Contract and/or applicable local laws.
Agent accepts no liability for the failure of public services such as water, electricity, (including services such as Internet or HVAC) when those services are beyond our control.
Agent accepts no liability for Contracting Guest’s personal safety, nor for the safety of those whom any guest invites onto The Property. It is particularly important that children be supervised at all times, in- and outside The Property. At all times, all guests are reminded to exercise care as to their personal safety—and for the safety of their party and companions—while in possession of The Property. Contracting Guest agrees that while in possession of The Property, all valuables should be left secure and out of sight; all windows and doors should be secured and locked while away from The Property.
Contracting Guest shall be solely responsible for any thefts, acts of vandalism, or other damage or loss of personal property which may occur during the course of this Contract, whether said damage or loss be the property of Guest(s) or any other person invited in by Guest(s), or of Agent. NOTE: Liability waivers/Hold Harmless provisions for recreational activities for select properties may be attached to and made a part of this Contract.

12. SMOKING: Smoking is not allowed inside The Property. Failure to comply with this provision (see House Rule below) shall result in Agent having the option to immediately terminate this Contract, increase the Cleaning Fee and/or assess a service charge of $500.00 plus the costs of cleaning, repairs, and any remediation of The Property, which Contracting Guest agrees shall be deducted from the refundable security/damage deposit and/or billed directly to Contracting Guest.

13. CANCELLATION POLICY: We have a STRICT CANCELLATION Policy: Cancel up to Seven (7) days before your reserved Check-in time and AirBNB will refund Fifty Percent (50%) of Accommodation Fees, as well as Service Fees and Cleaning Fees. Agent defers to AirBNB for all cancellation policies and disputes. Agent accepts no responsibility or liability for any loss, damage or alteration to the terms of contracting Guest’s reservation caused by events beyond our control, including, but not restricted to, war, terrorist activity, civil commotion, storms, flight delays or cancellations, airport closures, loss of luggage, adverse weather conditions, fire, flood, or industrial dispute.

14. DEFAULT: If the Contracting Guest shall fail to perform any provision and/or term of this Contract, Agent, at its option, may immediately terminate all rights of the Contracting Guest and the occupants. If the Contracting Guest abandons or vacates The Property having damaged The Property, in addition to all other legal remedies available, Agent may consider any personal property left on The Property to be abandoned and shall dispose of the same in any manner allowed by law. Contracting Guest shall be liable for the actions of all occupants, visitors or other persons on The Property during the Term.

15. INSURANCE: We strongly suggest that ALL Guests purchase TRIP CANCELLATION INSURANCE, and TRAVEL INSURANCE, which is available for a nominal fee directly through CSA websites, and other vacation insurance providers. This insurance can help cover guests in case of cancellation, and/or damage to The Property.

16. GENERAL HOLD HARMLESS AGREEMENT: In the event of injury or death to Contracting Guest, Guest’s child, dependent, or any other person or minor staying at or visiting The Property during the Term of this Contract, Contracting Guest hereby releases, holds harmless and agrees to fully indemnify owner(s) and their agents, heirs and assigns from any and all lawsuits, damages, claims or other expenses, including accidental death.
In addition to this general release, Contracting Guest acknowledges that specific hold harmless provisions may be attached to this Contract. Contracting Guest agrees that the specific hold harmless provisions are incorporated into and included in this Contract.

17. PARTIAL INVALIDITY: In the event that any provision of this Contract shall be held by a court to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not be affected or impaired.

18. RESOLVING DISPUTES; ATTORNEYS’ FEES: If the parties have any disputes or problems that they are not able to resolve between themselves, they agree that the dispute shall be resolved through arbitration in the county where The Property is situated. In the event that any action is filed in relation to this Contract, the unsuccessful party in the action shall pay, in addition to all sums that either party may be called upon to pay, a reasonable sum for the successful party’s attorney fees and court costs.

19. GOVERNING LAW: This Contract is to be construed under and governed by the laws of the State where The Property is located.

20. ENTIRE CONTRACT: This Contract, including the Hold Harmless Provisions and the House Rules following the signature page, sets forth all the promises, agreements, conditions and understandings between the parties concerning The Property, and there are no agreements, conditions or understandings, either oral or written, between them that are not set forth in this Contract. No alteration, amendment, change or addition to this Contract shall be binding upon either party unless reduced to writing and signed by each party.

21. VALIDITY OF FACSIMILE AND ELECTRONIC SIGNATURES: This Contract is intended to be signed by electronic signature. Pursuant to United States and international law, electronic signatures are valid and enforceable. (see Electronic Signatures in Global and National Commerce Act (ESIGN, Pub.L.106-229, 114 Stat. 464), enacted June 30, 2000, 15 U.S.C. chapter 96.) The e-signatures shall be held by DocuSign.com and stored permanently.

This Contract may be executed and delivered by facsimile or other means to any other party, and the receiving party may rely on the receipt of such document so executed and delivered as if the original had been received.

22. EXAMINATION OF CONTRACT: The submission of this Contract for examination does not constitute a reservation of or an option for The Property. This Contract shall become effective only upon execution by both parties and by delivering required fees to the Agent.

Contracting Guest acknowledges that a swimming pool and/or hot tub have been made available. Contracting Guest acknowledges the risks associated with a swimming pool and/or hot tub. Swimming pools and hot tubs can be dangerous especially to the young, elderly, pregnant and physically infirm. Risks are many and include, but are not limited to: drowning, overheating, stroke, dehydration and slipping and falling. Use of the hot tub should be limited to a maximum of 15 minutes per use; significantly less or none for the physically infirm. For health and safety reasons, persons under the age of 18 must be accompanied by a parent, guardian, or legal custodian, or someone who is 18 years of age or older, and who is authorized by parent, guardian or legal custodian to supervise such child. The accessibility of the pool/hot tub has been fully explained to Contracting Guest, and Contracting Guest —not Agent—agrees to accept responsibility for regulating the use of the pool and/or hot tub, including any use or prevention of use by children and the elderly and/or infirm. Contracting Guest understands that the risks described here, and other inherent risks, could cause injury and/or death, and Contracting Guest freely assumes those risks. Contracting Guest has, or will before use, explain these risks and this provision to all persons on The Property during Contracting Guest’s stay.

The parties agree to the terms of this Short-Term Rental Contract and Exhibit A-Rental/House Rules, as evidenced by the signatures set forth below.

HOUSE RULES

1. ARRIVAL & DEPARTURE: Upon Arrival, and during stay, all Guests agree to notify Management immediately of any and all damage, malfunction, improper cleaning, or any other concern to The Property or Unit(s). Failure to notify Management immediately of any damage, malfunction, improper cleaning, or any other concern to The Property or Unit(s) shall constitute as a waiver of any claims regarding the condition of The Property, the premises, or its facilities, and shall result in deductions from Security/Damage Deposit—or charged directly to Contracting Guest.

Historic Floors, Steps and Staircases: All Guests agree not to drag or roll luggage, baggage, or other items across any floor of The Property, nor to clomp any luggage, baggage, or other items up or down any steps or staircases, whether inside or outside the historic property. All Guests agree to carry all luggage, and to pre-arrange assistance with all over-sized or heavy items. Damage claims are costly and shall result in deductions from Security/Damage Deposit—or charged directly to Contracting Guest.

Upon Departure, all Guests agree to turn off all lights and fans, HVAC systems, kitchen oven(s) and burners, water faucets, as well as close, secure, and lock all doors and windows. At Departure, all trash and other items brought into the unit must be removed. See Cleaning Fee/Trash Disposal below.

We cannot accommodate early check-ins or late check-outs, or store Guest's luggage outside of reservation times. Please have each member of Guest's party arrange their travel schedule to accommodate the 4 pm check- in and 12 pm check-out times. (TIP: Guests flying to NOLA should consider later arrivals in the day for Check-in, and early flights-out on the day of Departure.)
Luggage, bags nor belongings are allowed on, or within, The Property until your Check-in Time, and must be removed from The Property at your scheduled Check-out Time. Failure to depart as scheduled shall result in additional fees to re-schedule cleaners and may result in a fee for an additional night’s stay. Please refer to your Booking Confirmation for Check-out Time.

Contracting Guest agrees to provide, share, and make known this Contract and Rental/House Rules to all other members of his or her party.


NOTE: This property utilizes Home Automation technology. Assigned Door Codes shall only function during the hours between the arrival and the departure times stated in Guest’s Booking Confirmation. Please, don't lock yourself out! Additional fees may apply.


2. PROPERTY & PREMISES: All Guests agree to keep The Property, the premises, and all furnishings and appliances in good order. Do not move indoor furniture to different rooms, nor outdoors. Do not bring outdoor furniture indoors. Use a cutting board when preparing food; do not use knives or utensils directly on counter tops or other inappropriate surfaces. Do not sit hot pots or pans on countertops or other inappropriate surfaces. Guests agree to use all appliances ONLY for their intended purpose.

PLEASE REMOVE ALL SHOES AT THE FOYER/ENTRANCE OF THE HISTORIC HOME, AT ALL TIMES.

All Guests agree to ensure that all doors and all windows are closed and locked when leaving The Property. Rainstorms occur often and suddenly throughout the year and can cause flooding and other damage.

Though the Property is located on a quiet, residential street, The Property should be secured at all times. If Management is required to travel to The Property to address doors or windows left open or unlocked, an additional trip fee shall be charged against the held security deposit, or if no deposit is held, billed directly to Contracting Guest. To prevent HVAC condenser freezes, all doors and all windows must remain closed while using the air-conditioning HVAC system. If doors or windows are left open for an extended period of time while using HVAC, the Home Automation system will automatically shut the system OFF.

NOTE: Multiple auto-shut-offs will LOCK the system to OFF mode, resulting in Guest’s need to contact Management to re-instate the system. Activation fees may apply. Any repairs to HVAC due to open doors or windows while in possession of The Property shall be billed directly to Contracting Guest.



3. UNKNOWN GUESTS: No Guest may bring any unknown person onto The Property who was not previously known to ALL Guests prior to Arrival. A scam at local bars, clubs, and elsewhere in NOLA is for a stranger to befriend tourists, and once inside their accommodation, to text a cohort about goods to be stolen. A break-in later follows. We have 24-hour exterior video surveillance, but that may not be fast enough to catch a thief. Guests should treat The Property as their own. All Guests should keep in mind that they are in an urban tourist-area when dealing with unknown individuals.
Over-night guests not identified in the Complete Guest List are not allowed, no exceptions.



4. PARTIES, EVENTS, FILMING: Advanced approval from Agent is required if any Guest intends to film anywhere on The Property. At no time may heavy equipment be brought into The Property, including filming equipment as well as sound and or lighting equipment. Advanced approval from Agent is required if any Guest intends to host a party or event on The Property. A party or event is defined as any gathering where persons not named in the Complete Guest List will be on the premises with extended access to The Property’s electrical system, water, plumbing, and other facilities and amenities specific to The Property. NOTE: a party or event consisting of only those guests named in the Complete Guest List shall also require advanced approval from Agent. An event fee may apply, and additional paperwork for insurance may be required. Simple specifics such as date, time, duration, and number of attendees must be prearranged with Agent. Due to the historic nature of The Property, at NO time may any decorations or adornments be installed or placed on The Property that require nails, screws, thumbtacks, tape, glue, paint, wax, or by any other means that may cause damage to any walls, ceilings, floors, moldings, trim, windows, doors, siding, fixtures, or to any other aspect of the interior or exterior of The Property.



5. TOILET USE: ONLY TOILET PAPER down the toilet—not even flushable wipes or other hygiene products! Do not flush nappies/diapers, sanitary pads, tampons, dental floss, tissues, or cotton pads, balls, or swabs. While in use, anything other than toilet paper and human waste will result in clogged pipes and a $500.00 (minimum) plumbing visit fee, as well as cleaning-and-repair costs. The street plumbing is older NOLA 1900s plumbing, so this rule MUST be followed. Feel free to flush a few times during use, if necessary. We provide starter toiletries only.



6. TOWELS & LAUNDRY: Please, DO NOT leave wet towels on furniture, on the wood floors, or hanging on doors or doorknobs to dry. It’s damaging and unsanitary. Instead, hang them to dry on the bathroom towel racks or door hooks, or you may use the hooks on the backside of the bedroom door(s). Wet towels may be left inside the bath tub or laundry basket at departure. Feel free to launder towels as needed. The washer requires High Efficiency (HE) detergent. Look for the (HE) logo and the words “High-Efficiency” when purchasing detergent. If non-HE detergent is used in the washing machine, soap-suds and water will flood the machine and damage the flooring. Please be mindful: ** Use ONLY (HE) detergent! **



7. SMOKING: Since the majority of our guests favor an indoor smoke-free vacation/stay environment, we have a very strict indoor NO SMOKING policy. To provide our guests the best possible experience during their stay in our home, Smoking (INCLUDING ELECTRONIC CIGARETTES and other vapor) is not allowed or permitted anywhere within The Property at any time. All Guests must smoke outdoors, and away from any open doors or open windows or open vents to The Property. Failure to adhere to these terms shall result in a minimum fee of $500.00 for remediation of The Property to smoke-free condition, including the costs of having the carpets, furniture, and HVAC cleaned. Please, smoke outdoors.

To accommodate our outdoor smoking guests, we provide ashtrays and/or sand-pots for temporary disposal in yard areas. Upon Departure, all Guests are responsible for the removal and disposal of all butts, matches and other debris from sand-pots and ashtrays to avoid any additional cleaning fees and/or forfeiture of the security deposit, if one held by Agent, or billed directly to Contracting Guest.

**PLEASE BE MINDFUL OF HOT ASH IN THE TRASH!**



8. POOL/JACUZZI/DECK (select properties*): Because there are no lifeguards or other attendants at the swimming pool, all guests are expressly responsible for the safety of themselves, members of their families, and guests using the swimming pool, and in so using or permitting to be used, specifically waive any and all liability claims. No Guest shall permit any juvenile member, any elderly, or any person with disabilities of this family or guests to play in or around the swimming pool without providing an attendant who is able to swim and can protect such guests in case of any difficulty in the water. All Guests are expected to conduct themselves with reasonable decorum. Any rough play or diving in the pool, or running on the deck, is Strictly Prohibited. Sitting or standing on the rim of the pool is dangerous and is Strictly Prohibited. By using the deck area, pool, and/or hot tub, all Guests acknowledge that these areas can be dangerous and slippery when wet, and that injury is likely to occur to anyone who is not careful. All Guests agree to observe and to adhere to all rules and policies as posted at The Property. All Guests accept and assume all risks involved in or related to the swimming pool, Jacuzzi, deck, and surrounding areas. Glassware is Strictly Prohibited in all outdoor areas, including deck areas, pool, and hot tub.


9. HOUSEKEEPING: There is no daily housekeeping or maid service. Bed, bath, and kitchen linens are provided in the unit, and guests are welcome and encouraged during their stay to wash towels and linens as needed in the washer/dryer. A dishwasher is provided for dishes and other kitchenware.
** TOWELS, LINENS AND OTHER HOUSEWARES MAY NOT BE REMOVED FROM THE PROPERTY AT ANY TIME. PLEASE CONTACT OUR PROPERTY MANAGER FOR DETAILS ON OTHER OPTIONS. **


10. CLEANING FEE/TRASH DISPOSAL: It’s pretty simple, but to avoid any deductions from Contracting Guest’s security deposit for extra cleaning, it is the responsibility of all Guests to remove all garbage from The Property—including from the bathrooms, and from the back- and side-yards, as well as all party items, perishables, personal items, etc. upon Check-Out/Departure. Garbage bags are provided under the kitchen sink, or nearby. It is also the Guests’ responsibility to clear and return any dishware, cookware or other items brought from inside the home to any outdoor space.

Because we are not a hotel (we do not provide maid or housekeeping services), the Cleaning Fee is for the cleaners to restore the Unit to the condition it was in when you, our Guests, arrived. The Fee is not applied to the removal of brought-in items left behind at Departure. Additional fees shall apply.

**IF YOU BRING IT IN, YOU MUST TAKE IT OUT WHEN YOU DEPART.**

Failure to adhere to these terms may result in deductions from, or forfeiture of, the security deposit, and may incur other fees directly charged to Contracting Guest.

Garbage receptacles are located at the front of The Property, or thereabouts: large black bins for general garbage, and bins marked for Recyclables, which includes plastic, metal, and non-soiled paper. Glass is NOT recycled in NOLA, so all glass goes into regular garbage.

The receptacles you may use are labeled with the street number of The Property on them. Please, do not use any neighboring receptacles on the street, and do not move the receptacles from their locations.

The trash collection schedule is stated in Contracting Guest’s Booking Confirmation, as well as in the Guest Manual located within the unit. Unless otherwise stated in Booking Confirmation, Contracting Guest is responsible for moving garbage bins to curbside on pick-up days. If you need additional trash bags during your stay, please let us know.



11. NOISE: We encourage Guests to enjoy our outdoor areas, but remember that while you are on vacation, the neighbors are not. We are not a “party house.” Our neighbors will NOT tolerate lots of noise or obnoxious or illegal behavior, nor do we. New Orleans is a very tolerant city, but it is not a mini “Las Vegas.”

Please be considerate to those living around you: keep outdoor conversations at low noise-levels after 9:00 p.m. or move indoors.

Quiet Hours are between 10 p.m. and 7:00 a.m.

If Management is required to travel to The Property to address noise complaints, an additional trip-fee shall be charged against your security deposit, or billed to Contracting Guest directly, or may result in immediate eviction from The Property.



12. FOOTWEAR: All Guests agree to remove all shoes at the foyer/entrance of The Property or Unit(s) at all times. Socks and soft-soled slippers are fine on the historical wood flooring. (Select Properties: Please avoid wearing shoes on any carpet upstairs.)



13. SECURITY AND INTERNET: All Guests agree to refrain from altering, tampering with, or disabling any aspect of The Property’s Security System, including but not limited to outdoor lighting, door sensors, window sensors, motion sensors, security cameras or alarms, as well as any aspect of The Property’s Internet System, including hubs, routers, cables, power cords, etc.

Tampering with The Property's security or internet systems shall result in immediate eviction and automatic forfeiture of any held security deposit. The Home Automation system notifies us immediately of any breach.

Additionally, Contracting Guest shall inform all guests that The Property’s Wi-Fi Internet service MAY NOT be used to download any illegal file at any time. Our Internet service provider notifies us of any such occurrence, along with the device’s MAC and NIC identifiers, the name of the file downloaded, date and time. Upon notice, we shall provide authorities all information we may have on file, including identification and complete names on Guest List.

Any issues regarding Internet, Cable, or Satellite TV should be made known to Management immediately.



14. ANIMALS: As much as we love the furries and their friends, Animals (furry or not) are NOT allowed on The Property at ANY time, for any reason, ever. Any violation of this House Rule shall result in the immediate forfeiture of any Security/Damage Deposit on hold, and may result in immediate eviction from the Property, as well as additional charges for the remediation of the property to the state prior to Guests’ arrival. If no Deposit is held while in violation of this House Rule, any costs incurred by Agent, or Homeowner, shall be charged directly to Contracting Guest for the cleaning, treatment of fleas, or any other remediation issue related to any animal on The Property during Guests’ stay. Please, have visiting friends secure their animal(s) at curbside. Future guests with allergies will thank you, and so will your pocket-book.



15. DELIVERIES & LEFT-BEHIND ITEMS: This property is a Vacation Rental and has no on-site staff; as such, it is understood and agreed to by all Guests that the delivery of any parcel, package or other deliverable is done so at the Guest’s own risk, including prior to, during, and after Guests’ reserved stay. Agent (and assigns) shall bear no responsibility to handle any aspect of any delivery, or package pick-up, initiated by any Guest at any time, for any reason. Any delivery to the property after check-out time shall be discarded. Agent has no means to track or to store any deliverables or left-behind items. It is strongly suggested that any delivery or package pick-up be pre-arranged with a local mail-and-shipping center, numerous around the city.

Additionally, any personal item—including jewelry, clothing, a teething-bottle—left behind by any Guest after check-out shall be discarded; due to same-day check-ins, Agent has no means to authenticate nor verify any Guest’s claim against any loss. All left-behind cash shall be considered to be a “tip” to the cleaning staff. To be clear, all guests are encouraged to leave all valuables at home, to take pictures on their mobile device of the things they want with them while they travel. Agent (and assigns) shall bear no responsibility to manage the handling of, the return of, or the shipment of any item left behind after check-out.



16. PARKING: There is ample street parking -- be careful not to block driveways or fire hydrants. Towing is common in New Orleans; be aware of illegal parking zones. Car rental is not suggested during Mardi Gras season due to street closures and limited parking availability.

17. FIRE: Due to the limited amount of outdoor space on The Property, and to the close proximity of other homes and buildings, ANY USE OF FIRE outdoors (including bonfires, fire pits, BBQ grills, torches, fireworks, candles, etc.) is STRICTLY PROHIBITED. NO OPEN FLAME. The Property is equipped with fire extinguishers and smoke and Co2 detectors for emergency purposes.
